A Delhi court has granted anticipatory bail to senior journalist Vinod Dua in a case wherein Delhi BJP Leader Naveen Kumar has alleged in a complaint that he made defamatory remarks on his Youtube show.
The investigating officer said that the custodial interrogation of Dua was not necessary. Hence, relief was granted by Additional Session Judge Vineeta Goyal. The Court also directed the journalist to cooperate with the IO in the investigation and the police to not take any coercive steps against Dua till the next date of hearing i.e. June 29.
The Counsel for Dua contended that he had a fundamental right to freedom of speech and expression under the Constitution. He further submitted that Dua was 66 years old and suffering from diabetes, thalassemia minor, chronic liver disease, low platelet counts and other multiple medical conditions due to which he was vulnerable to the present Covid-19 pandemic.
The FIR was lodged on June 4 at Laxmi Nagar Police Station in East Delhi. Dua has been booked under several sections of Indian Penal including Section 290 (public nuisance), Section 505 (statements conducive to public mischief) and Section 505(2) (statements creating or promoting enmity, hatred or ill-will between classes).
Dua has also filed a petition in the Delhi High Court for quashing of the FIR which states that Dua in his Youtube channel only highlighted the mishandling of the riots by the government and police authorities.
