Taking note of the plight of migrant workers, on Tuesday, a three-judge bench of the SC case, which comprised of Justices Ashok Bhushan, Sanjay K Kaul, and MR Shah, ordered States and Union Territories to identify and send those migrants who wish to return their home states within 15 days. The railway has also been directed to provide ‘Shramik trains’ within 24 hours of demand raised by any state.
The court took suo motu cognizance of this case relating to transportation, registration, and employment of migrant workers stranded by the lockdown. It further noticed that though a substantial number of stranded workers have already been transported back to their states by state governments and railways but still, many migrants are stranded in Delhi, Maharashtra, West Bengal, Tamil Nadu, and Gujarat.
The bench headed by Ashok Bhushan said that,“There are huge lapses on the part of the state authorities in implementing state policies and decisions and most of the claims are only on paper”
The court further directed to ensure registration of around one Crore migrant workers at village and block levels, in order to determine their employability and provide them job opportunities in the home states.
It has also asked the government to withdraw all the cases filed against migrant workers for alleged violation of lockdown norms in an attempt to reach their hometowns.
